CCI Dismisses Allegations of Abuse of Dominance against Eagle Burgmann

On March 10, 2021, CCI dismissed a complaint by GAIL (India) Limited (‘GAIL’), alleging abuse of dominance against Eagle Burgmann India Private Limited (‘EBIPL’).[1]

GAIL alleged that EBIPL was exploiting its dominance in the market for ‘mechanical seals’ in the ‘Pata Petrochemical Plant’ by ‘locking in’ customers such as itself and selling mechanical seals and spares at high prices.

CCI, however, dismissed the allegations, finding that the market structure did not indicate EBIPL’s dominance.
