Industrial Employment Standing Orders Act – Karnataka Exemption

The Government of Karnataka has exempted IT/ITeS companies, startups, companies in the animation, gaming, computer graphics, telecom, BPO, KPO, and other knowledge based sectors from the applicability of the provisions of the Industrial Employment (Standing Orders) Act, 1946 for a period of five years from the date of publication of the notification in the official gazette. Please see attached.

The exemption is subject to the establishment:

(i)      constuituting an internal committee as per the Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act, 2013;

(ii)     constituting a grievance redressal committee consisting of equal number of persons representing employers and employees, to address any employee grievances;

(iii)    intimating the jurisdictional Deputy Labour Commissioner and Commissioner of Labour in Karnataka on cases of disciplinary action like suspension, discharge, demotion, termination, dismissal, etc.; and

(iv)   promptly and fully submitting to the jurisdictional Deputy Labour Commissioner and Commissioner of Labour in Karnataka any information sought in respect of the service conditions of employees.
