Treatment of Crown Debts in Indian Insolvency: Perspectives and Way Forward

Our team has authored this article for the Insolvency and Bankruptcy Board of India’s Research Publication titled ‘Navdrishti: Emerging Ideas on IBC’.

In their article, they have shared their thoughts on the treatment of crown debts under IBC, highlight the importance of subordinating crown debts to secured creditor dues in distribution of resolution proceeds, and discuss the concerns surrounding the judicial interpretations on this issue.
