Before Supreme Court of India in its decision to uphold the simultaneous execution of foreign decrees under Section 44-A of the CPC

On March 23, 2026, the Supreme Court of India affirmed the decisions of the Delhi High Court in overwhelming terms, and upheld the simultaneous execution of foreign decrees under Section 44-A of the CPC simultaneously in cause countries and forum countries (such as India). The judgment is significant not only because of the relief it grants our clients, but also because it lays down law on a nuanced and relatively unexplored subject within the Indian execution landscape which the AZB team developed right before the Delhi High Court – that of the permissibility of execution of foreign decrees in India and the cause country simultaneously.
