Commencement of Limited Liability Partnership (Amendment) Act, 2021

The Ministry of Corporate Affairs (‘MCA’) by a Notification dated February 11, 2022, has appointed April 1, 2022, as the date of commencement of Sections 1 to 29 of the Limited Liability Partnership (Amendment) Act, 2021, which had been previously notified by the Ministry of Law, by its Notification dated August 13, 2021. Through these amendments to the Limited Liability Partnership Act, 2008, the Government seeks to improve ease of doing business and these amendments inter alia deal with de-criminalisation of offences by providing for monetary penalties, recognition of the concept of start-up limited liability partnerships (‘LLP’), introduction of the concept of small LLPs, empowering the Regional Director to compound the offences, and establishment of special Courts for speedy adjudication of offences.
