Form CAR-2020 (Company Affirmation of Readiness Towards COVID-19)

Further to our Client Alert dated March 21, 2020 on the measures taken by the Ministry of Corporate Affairs (‘MCA’) in light of the COVD-19 outbreak (available here), the MCA has, on March 23, 2020, introduced Form CAR-2020 (Company Affirmation of Readiness towards COVID-19) to be filled by all companies/ foreign companies/LLPs/ foreign LLPs. The form requires companies/ LLPs to confirm compliance of COVID-19 guidelines including implementation of work from home policy.

For ease of filing, no payment is required to be made for filing. Further, any authorized signatory of the company/ LLP can file the form online and no DSC is required to be affixed. An OTP will be sent for verification to the authorized signatory’s mobile number.

The form is live on the MCA website and the companies/ LLPs are requested to file this at the earliest convenience. The MCA has clarified that non-filing of Form CAR-2020 will not attract any penalty or enforcement action.
