Full Bench of the Bombay High Court to Decide Whether Courts can Grant Transit Anticipatory Bail when the Offence is Registered in Another State

A full bench of the Hon’ble Bombay High Court is currently considering inter alia whether the trial courts or High Courts in a particular state can grant transit anticipatory bail to an accused in respect of an offence registered in a different state. The power of courts to grant transit anticipatory bail was considered to be inherent under Section 438 of the Code of Criminal Procedure, 1973. We look forward to providing an update of any further developments in this aspect.
