Labour Department Notification Regarding Employees Infected With Coronavirus

The Department of Labour, Karnataka has issued notification dated March 05, 2020, mandating preventive measures in light of the coronavirus outbreak. Set out below are the key takeaways from this notification:

For employees covered under the Employees' State Insurance Act, 1948 (ESI Act)

•   Employees who suffer from the symptoms of the infection are required to immediately visit the nearest ESI hospital/clinic for testing and treatment.

•   Infected employees are required to obtain a certificate from the relevant medical officer stating that they have been infected and submit the same to their employer.

•   On submission of such certificate, employers are required to grant twenty eight (28) days of mandatory sick leave to infected employees.

For employees not covered under the ESI Act

•   Employers are required to provide infected employees with twenty eight (28) days of mandatory paid sick leave under the Karnataka Shops and Commercial Establishments Act, 1961.
