Madras HC Holds that Credit Rating Agencies are not Amenable to Writ Jurisdiction

The Madras High Court in Mahasemam Trust v. Union of India and Ors.[1] has held that credit rating agencies do not fall within the ambit of term ‘State’ under Article 12 of the Constitution of India, as they do not discharge any public function. Therefore, they are not amenable to the writ jurisdiction of the Courts of India.
