Payment of Gratuity Act – Ceiling to be Doubled

The Union Cabinet has, on September 12, 2017, given its approval for introduction of the Payment of Gratuity (Amendment) Bill, 2017 (‘Bill’) in the Parliament. The Bill seeks to double the maximum limit of gratuity under the Payment of Gratuity Act, 1972 (‘Gratuity Act’) from Rs. 10 lakhs (approx. US$ 15,000)[1] to Rs. 20 lakhs (approx. US$ 30,000).[1]     The Gratuity Act entitles every employee who has completed five years of service, upon cessation of employment, to gratuity calculated at the rate of 15 days wage for each year of completed service or part thereof in excess of six months, currently subject to a maximum of Rs. 10 lakhs (approx. US$ 15,000).
