Amendment to UL Agreement for ISP Authorisation Regarding Adjusted Gross Revenue

The DOT has, by way of Notification no. 20-271/2010 AS-I(Vol.-V) dated May 19, 2022, amended the terms and conditions of the UL Agreement for internet service providers (‘ISP’) authorisation regarding adjusted gross revenue. Some of the key changes to the existing framework introduced by the DOT, inter alia, include: (i) permitted deductions for pass-through charges and taxes/ levies in case of access services; and (ii) removal of condition of exclusion for charges of pass-through nature paid to other telecom service providers to whose network the licensee’s network is interconnected for calculating the adjusted gross revenue.
