Compliance with Directions for Implementation of Digital Consent Acquisition Facility

The Telecom Regulatory Authority of India (‘TRAI’) by way of Press Release dated November 7, 2023 has directed access providers and entities sending commercial communication through voice calls or short message service (‘SMS‘) (‘Principal Entities’), to take necessary steps to deploy the new Digital Consent Acquisition (‘DCA’) facility which will be used for collecting and recording customer consent for sending commercial communications under the Telecom Commercial Communications Customer Preference Regulations, 2018 (‘TCCCPR’). The use of the DCA facility by Principal Entities will take place in a phased manner and initially those belonging to banking, insurance, finance, and trading related sectors will be on–boarded. The Principal Entities will not be able to send commercial communication through voice calls or SMS on failure to deploy the DCA facility.
