SC Holds that Chargesheet and Other Documents Produced Along with Chargesheets Cannot be Published in Public Domain

In Saurav Das v. Union of India and Others[1], the SC held that the copies of chargesheet and other relevant documents enclosed in the chargesheet and relied by prosecution is to be furnished only to the accused under the Code of Criminal Procedure, 1973 (‘CrPC’). The Court held that these documents cannot be published in public domain as it will violate the rights of the accused as well as the victim and/or the investigating agency.
