AZB & Partners advised Ahmedabad-Maliya Tollway Private Limited (AMTPL, through Sekura India Management Limited) in drafting, negotiating and successfully executing the engineering, procurement and construction agreement with Kalthia Engineering and Construction Limited (KECL), for the six-laning of the four-lane Ahmedabad-Maliya state highway in Gujarat, from Shantipura Chokdi to Khoraj, on a BOT (toll basis). Through this contract, AMTPL (the concessionaire) has engaged KECL for as the turnkey contractors to carry out the engineering, procurement and construction of the six-lane highway.
The transaction involved intense negotiations spread over weeks and our team constantly developing strategies, multiple “quick turn-around” of the drafts, and also many last minute adjustments to the agreement to align commercial priorities, and the unique requirements of AMTPL and KECL. This transaction spanned over a few months with very demanding asks and timelines.
