NCLAT Rules on Homebuyers’ Claims Submitted after Approval of Resolution Plan

The National Company Law Appellate Tribunal (‘NCLAT’) in Puneet Kaur v. K.V. Developers P. Ltd,[1] held that the claims of homebuyers which were not filed with the resolution professional but are reflected in the corporate debtor’s records, ought to be included in the information memorandum by the resolution professional. The resolution applicant is expected to deal with these liabilities appropriately in their resolution plan.
